Cette étude constitue une première approche juridique de la problématique AMURE. Elle est centrée sur l'accès aux ressources halieutiques. Compte tenu de l'ambition à la fois pluridisciplinaire, théorique et appliquée du Programme AMURE les contributions qui la composent sont nécessairement diversifiées. Certaines ont pour vocation première de rappeler les données de base des problèmes juridiques relatifs à l'accès aux ressources halieutiques et de permettre ainsi d'engager un dialogue interdisciplinaire. D'autres contributions, plus originales, dégagent les aspects conceptuels du sujet ou apportent un éclairage inédit sur la formation du droit français des pêches. Ocean grabbing occurs when traditional users, such as small-scale fishers, are pushed aside by new development activities. This grabbing must be prevented to avoid sea uses that maintain or increase social inequity. In this paper, we show that in tropical Atlantic countries, such as Brazil and Senegal, examples of ocean grabbing already occur. In this context, we analyse if Maritime Spatial Planning (MSP) may be an opportunity to limit ocean grabbing or, to the contrary, poses a risk to increase it.
